1. Introduction

These Terms of Service (“Terms”) govern your access to and use of the website www.maramegelea.com (the “Site”) and any services or products offered by Megelea SA (“Megelea,” “we,” “us” or “our”). By browsing the Site or placing an order, you agree to be bound by these Terms, our Refund & Return Policy, Warranty Policy, Shipping Policy and Privacy Policy. If you do not accept these Terms, you may not use the Site or purchase products.

2. About Us

Megelea SA is a Swiss company. We design and handcraft fine jewellery, all of which is made to order or custom-made jewellery.

3. Formation of Contract

An order placed through our Site constitutes an offer to purchase. After you submit an order, we will send a confirmation of receipt; this confirmation does not constitute acceptance. A binding contract arises only when we send you an Order Confirmation e‑mail indicating that your order has been accepted and production has commenced. Before placing an order, you will be given the opportunity to review your cart, correct any errors and enter or amend delivery and billing information.

4. Eligibility

By placing an order, you confirm that you are at least the age of majority in your country of residence or have consent from a legal guardian, and that all information you provide to us is true, accurate and complete. You agree to keep your account information up to date to enable us to fulfil your orders.

5. Pricing, Taxes and Payment

All prices on the Site are quoted in Swiss francs (CHF) unless otherwise indicated. Prices are subject to change without notice. For deliveries within Switzerland, prices include Swiss VAT. For deliveries outside Switzerland, you are responsible for any customs duties, import taxes or brokerage fees. We accept payment by major credit cards and any additional methods shown at checkout. Payment for bespoke pieces is due in full when we accept your order.

6. Products and Custom Work

Every piece of jewellery we sell is either made to order or custom-made to your specifications. We endeavour to display product images and descriptions accurately, but variations may occur due to device settings. Because of the bespoke nature of our work, all sales are final once production has begun; please ensure all details (metal type, ring size, engraving text, etc.) are correct before confirming your order.

7. Delivery and Risk of Loss

Processing and production times vary depending on the complexity of the piece (generally 4–8 weeks). Domestic orders are shipped via La Poste Suisse and typically arrive within 4–7 business days; international orders are shipped via DHL Express and delivery times vary. All shipments are insured and require a signature on delivery; risk of loss transfers to you once the package is signed for. Delivery dates are estimates and not guaranteed. We are not liable for delays caused by customs procedures, carriers or events beyond our control (force majeure).

8. Returns and Right of Withdrawal

Under Swiss law there is no statutory right to withdraw from or return online purchases. Because all our jewellery is custom-made, we do not accept cancellations, returns or exchanges once production has commenced. We will only accept returns if a piece has a manufacturing defect covered by our warranty. Please refer to our Refund & Return Policy for details on reporting defects.

9. Warranty

We warrant that our jewellery is free from manufacturing defects for two (2) years from the date of delivery. The warranty covers manufacturing faults such as loose stones or faulty prongs and excludes normal wear and tear, loss, theft and damage caused by misuse or unauthorised modifications. If a defect is confirmed, we will repair or replace the item as described in our Warranty Policy. This warranty is in addition to any mandatory rights you may have under Swiss law.

10. Intellectual Property

All content on the Site—including text, images, designs, logos and trademarks—is the property of Megelea SA or its licensors. You may not reproduce, distribute, modify or use our content for commercial purposes without our prior written consent.

11. Limitation of Liability

Except as expressly stated in these Terms, the Site and all products and services are provided “as is” without any warranties of any kind. To the extent permitted by law, Megelea SA shall not be liable for any indirect, incidental or consequential damages arising out of or in connection with your use of the Site or products. Our total liability for any claim shall not exceed the amount you paid for the product in question. Nothing in these Terms limits liability for gross negligence, wilful misconduct or any liability that cannot be excluded under Swiss law.

12. Indemnity

You agree to indemnify and hold harmless Megelea SA and its directors, employees and agents from any claim, demand or damages arising from your breach of these Terms or misuse of the Site.

13. Governing Law and Jurisdiction

These Terms and any disputes arising hereunder are governed by Swiss law. The courts of Lausanne, Switzerland have exclusive jurisdiction. If you access the Site from outside Switzerland, you are responsible for complying with local laws.

14. Privacy

We collect and process personal data in accordance with our Privacy Policy, which forms part of these Terms.

15. Modifications to Terms

We may update these Terms from time to time. Any changes will be posted on the Site and are effective immediately for new orders and 30 days after posting for existing customers. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
